Mirena IUD Lawsuit News: Bernstein Liebhard LLP Notes Growing Mirena Side Effects Litigation in Canada

All of the Mirena IUD lawsuits pending in U.S. courts accuse Bayer Healthcare Pharmaceuticals of failing to provide adequate warnings regarding the potential for Mirena to migrate from its proper position in the uterus long after it has been correctly inserted by a healthcare provider. Instead, plaintiffs claim that U.S. Mirena label only warns that migration can occur if the uterus is punctured during the IUD’s initial implantation.
In 2009, Bayer was cited by the U.S. Food & Drug Administration (FDA) for a Mirena promotional campaign that the agency found to be misleading. Among other things, the FDA asserted that the campaign included statements that exaggerated the IUD’s benefits and downplayed the potential for serious Mirena side effects. According to a report that was broadcast by 7 Action News last August, the FDA has tallied more than 70,000 complaints involving Mirena complications, including thousands of reports of device dislocation and uterine perforation, since the device was launched on the U.S. market in 2000.**
