300 Mirena Lawsuit Claims Now Filed in New Jersey Litigation, Upcoming Status Conference Scheduled for January, Bernstein Liebhard LLP Reports

A total of 300 Mirena lawsuit (http://www.filemirenalawsuit.com/) claims are now pending in a multicounty litigation underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports.

According to a Case List update from November 21st, claims filed in this proceeding are increasing at a steady rate after being filed by women who allege spontaneous device migration, uterine perforations and other IUD complications. Plaintiffs in Mirena lawsuits allege that Bayer Healthcare Pharmaceuticals, the makers of this contraceptive implant, failed to adequately warn women and their doctors about its potential to cause patient injuries. Court documents indicate that this proceeding is continuing to move forward as well, with an upcoming Case Management Conference scheduled for January 14th at 1:00 p.m. (In Re: Mirena Litigation; Case No. 297)

Mirena Lawsuits

Since Mirena’s U.S. launch in 2000 as a contraceptive, the IUD has been associated with device dislocation, ectopic pregnancy, infection, vaginal scarring and other complications. In that time, a report released last summer by 7 Action News showed that approximately 70,000 Mirena-related complaints have been filed in the U.S. Food and Drug Administration (FDA)’s adverse event report database. The Mirena IUD’s list of approved uses expanded in 2009 to include the treatment of heavy menstrual bleeding in women who opt to use it as their method of contraception.*

In conjunction with this increase in uses, however, court documents indicate that more and more women have alleged injuries caused by the Mirena IUD. In addition to the 300 cases now pending in the consolidated Bergen County Superior Court proceeding, hundreds of lawsuits have been filed at the federal court level as well. An update issued November 18th by the U.S. Judicial Panel on Multidistrict Litigation indicates that a total of 267 Mirena lawsuits are now pending in a multidistrict litigation established in the U.S. District Court, District of Minnesota.
