Hundreds of Mirena IUD lawsuits (http://www.filemirenalawsuit.com/) filed on behalf of women who suffered serious injuries allegedly due to spontaneous migration of the device continue to move forward in courts around the country, Bernstein Liebhard LLP reports. According to an Order issued on December 19, 2013, a Plaintiff in a Mirena lawsuit pending in U.S. District Court, Northern District of California, will be allowed to pursue claims of negligence, failure to warn and breach of warranty against Bayer Healthcare Pharmaceuticals, after the judge presiding over the case found that her pleadings were sufficient. Among other things, the Plaintiff alleges that Bayer failed to exercise reasonable care in designing the IUD, and concealed the risk of serious Mirena complications. (Baker v. Bayer Healthcare Pharmaceuticals Inc., No. C13-490)

According to court documents, nearly 600 Mirena lawsuits alleging serious injuries, including uterine perforations, embedment, and organ damage due to spontaneous migration are currently pending in courts throughout the U.S. This includes at least 300 claims that have been filed in a multicounty litigation underway in Bergen County Superior Court in New Jersey. (In Re: Mirena Litigation; Case No. 297). Another 296 claims have also been filed in a federal proceeding established in U.S. District Court, Southern District of New York. According to court filings, plaintiffs in these claims allege that Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risks associated with the IUD, and downplayed serious Mirena complications. Among other things, they point out that Bayer received a Warning Letter from the U.S. Food & Drug Administration (FDA) in December 2009 that faulted one of the company’s Mirena promotions for exaggerating the benefits purportedly associated with the IUD, and understating its risks.
