More than 600 Mirena lawsuits (http://www.themirenalawsuitcenter.com) filed on behalf of women who allegedly sustained serious injuries due to spontaneous migration of the IUD continue to move forward in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to court documents, the litigation’s most recent Case Management Conference was convened on February 25, 2014, at which time a number of Pretrial Orders were issued. Among other things, the Court has established abbreviated service procedures for service upon certain defendants, including Bayer Healthcare Pharmaceuticals, Inc., Bayer OY and Bayer AG. In addition, the Court scheduled the proceeding’s next Case Management Conference for April 1, 2014. (In Re: Mirena Litigation; Case No. 297)

According to court documents, at least 630 Mirena lawsuits are currently pending in the New Jersey multicounty litigation. Among other things, the lawsuits claim that Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risk of spontaneous migration, and only warned that migration could occur if the uterus was perforated upon insertion of the IUD. Plaintiffs in these lawsuits further allege that the migration of their IUD resulted in a number of serious Mirena complications, including uterine perforation, organ damage, scarring, infection and infertility.
In addition to the claims pending in New Jersey, court documents indicate that more than 400 federally-filed Mirena lawsuits that involve similar allegations are pending in a multidistrict litigation underway in U.S. District Court, Southern District of New York. The Mirena IUD has been available in the U.S. Market since 2000, and is now approved as a method of birth control, as well as a treatment for heavy menstrual bleeding for women who wish to use an IUD as their primary method of contraception. In 2009, the U.S. Food & Drug Administration (FDA) cited Bayer for a promotional campaign that the agency said made misleading claims regarding the benefits of the IUD, and that also downplayed the risk of serious Mirena complications.
Alleged victims of serious Mirena complications related to spontaneous migration of the IUD may be entitled to file their own Mirena lawsuit in order to obtain compensation for their injuries.
