Mirena Lawsuit Filings Grow, as Claims Pending in Federal Litigation Exceed 1,000, Bernstein Liebhard LLP Reports

According to an updated Case List issued by the U.S. Judicial Panel on Multidistrict Litigation (JPML) on October 15th, at least 1,042 Mirena claims are now pending in the multidistrict litigation underway in the U.S. District Court, Southern District of New York. Mirena IUD Litigation
The Mirena IUD was first approved by the U.S. Food & Drug Administration (FDA) in 2000. It is indicated for contraception, and for the prevention of heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control. In 2009, the FDA issued a Warning Letter to Bayer Healthcare Pharmaceuticals after finding that one of the company’s Mirena promotions made misleading claims about the safety and efficacy of the IUD.
According to court documents, thousands of women have filed Mirena lawsuits in the Southern District of New York and elsewhere that allege spontaneous migration of the IUD caused uterine perforations, scarring, adhesions, infections, infertility, and other serious complications. Among other things, these lawsuits accuse Bayer of downplaying the risks associated with the IUD, and of failing to warn that the device might migrate even after being properly inserted into the uterus by a healthcare provider. The claims point out that the Mirena label only warns that migration might occur if the uterus is perforated when the IUD is being implanted.
In addition to the Mirena claims pending in New York federal court, court records indicate that nearly 1,100 lawsuits that put forth similar allegations have been filed in a multicounty litigation established in New Jersey’s Bergen County Superior Court.
