Mirena IUD Lawsuit News: Filings in New Jersey Litigation Surpass 1,200, Bernstein Liebhard LLP

According to a new Case List issued by the Court on October 27th, 1,228 Mirena lawsuits are now pending in the proceeding. Mirena IUD Litigation
First launched in the U.S. in 2000, the Mirena IUD is a long-acting method of birth control that is indicated for contraception and as a treatment for women with heavy menstrual periods who wish to use an IUD as their primary method of birth control. In 2009, the FDA issued a Warning Letter to Bayer Healthcare Pharmaceuticals after finding that one of the company’s Mirena promotions made misleading claims about the safety and efficacy of the IUD.
According to court documents, all of the Mirena lawsuits pending in New Jersey allege spontaneous migration of the IUD caused uterine perforations, scarring, adhesions, infections, infertility, and other serious complications. Among other things, these claims accuse Bayer Healthcare Pharmaceuticals of failing to warn that the device might migrate even after being properly inserted into the uterus by a healthcare provider. The claims point out that the Mirena label only cautions that migration might occur if the uterus is perforated when the IUD is being implanted. Finally, the lawsuits allege that Bayer has a history of downplaying the risks associated with Mirena, and of overstating its purported benefits.
In addition to the Mirena claims pending in New Jersey Superior Court, court records indicate that at least 1,042 lawsuits that put forth similar allegations have been filed in a multidistrict litigation now underway in U.S. District Court, Southern District of New York.
