Mirena IUD Lawsuits Move Forward, as Bernstein Liebhard LLP Notes New Report Detailing Rising IUD Use in Canada

According to one medical expert interviewed for an article published by The Globe and Mail, IUD insertions are up by about 34% over the past three years at one Vancouver clinic, while another reported a nine-fold increase since 2009.*

Mirena Side Effects
The Mirena IUD was approved as a contraceptive by the U.S. Food & Drug Administration (FDA) in 2000, and its approved uses were expanded in 2009 to include the treatment of heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control. According to a report that aired on 7 Action News this past summer, since its initial approval in 2000, the FDA has logged over 70,000 complaints involving Mirena, including thousands that detail cases of device dislocation and uterine perforation.* In December 2009, the agency issued a Warning Letter to Bayer Healthcare Pharmaceuticals after it determined that a promotional campaign for the IUD made misleading claims about its benefits and the risk of Mirena side effects.
According to court documents, nearly 600 Mirena IUD lawsuits alleging injury due to spontaneous device migration have been filed in courts throughout the U.S. These claims include at least 300 that are pending in a multicounty litigation underway in Bergen County Superior Court in New Jersey. (In Re: Mirena Litigation; Case No. 297). Another 296 Mirena lawsuits have also been filed in a federal proceeding established in U. S. District Court, Southern District of New York. The complaints allege that spontaneous migration of the device caused women to suffer uterine perforations, infertility, organ damage, and other painful Mirena side effects. Plaintiffs further allege that Bayer Healthcare Pharmaceuticals failed to warn about the potential for this occurrence.
