Mirena IUD Lawsuits Progressing in New Jersey Court, Rottenstein Law Group LLP Reports
(PRWEB) October 11, 2013 -- Mirena IUD lawsuits are moving along as scheduled in a New Jersey Superior Court consolidation of Mirena cases, according to court documents. There are more than 200 lawsuits pending in the multicounty litigation formed in May 2013 before Judge Brian R. Martinotti, according to court documents (In re Mirena Litigation; Case No. 297, Superior Court of New Jersey, Bergen County). During the Sept. 25 case management conference, the court established some protocols for evidence gathering and scheduled several subsequent conferences, the next one occurring on Nov. 20.
“We are of course pleased that these cases are progressing,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP. “The sooner these cases go to trial, the sooner the plaintiffs have the potential to obtain compensation for the harms they have suffered.”
There are also about 200 Mirena lawsuits pending in a consolidation of cases in federal court, according to court documents (In re: Mirena IUD Products Liability Litigation; MDL-2434, U.S. District Court for the Southern District of New York). Despite the current government shutdown, those cases are progressing as well.
The U.S. Food and Drug Administration has received more than 70,000 adverse event reports regarding the Mirena since the IUD’s 2000 debut, according to court documents. The complaints centered on a few potential side effects, including device migration and uterine perforation, both of which could involve the IUD becoming embedded elsewhere.
The Mirena IUD is a plastic intrauterine device that is implanted in a woman’s uterus for five years, over which time it slowly emits a dosage of progestogen to prevent pregnancy, according to court documents.
