Mirena IUD Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Scheduling of February Case Management Conference in New Jersey Mirena Litigation

Court documents indicate that at least 488 Mirena IUD lawsuits are now pending in the proceeding underway in New Jersey. Plaintiffs in these lawsuits are alleged to have suffered a number of Mirena side effects, including uterine perforations, pain, scarring, infection, and infertility, following spontaneous migration of the IUD. Plaintiffs further allege that Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risk of spontaneous migration, and only warned that migration could occur if the uterus was perforated when the IUD was inserted.
In addition to the claims pending in New Jersey, 344 Mirena lawsuits involving similar allegations are pending in a federal multidistrict litigation underway in U.S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)
The Mirena IUD is a contraceptive device that was cleared for sale in the U.S. by the Food & Drug Administration (FDA) in 2000. In 2009, the FDA approved expanded use of Mirena to treat heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control. In December of that same year, the agency issued a Warning Letter to Bayer after finding that one of its campaigns promoting Mirena overstated its benefits and downplayed the risk of serious Mirena side effects.
