Mirena IUD Lawsuits
The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) as a contraceptive in 2000, and its approved uses were later expanded to include treatment of heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control. In 2009, Bayer received an FDA Warning Letter which criticized the company for making claims about the purported benefits of the IUD and its potential side effects that the agency deemed to be misleading. According to recent media reports, the FDA has received more than 70,000 complaints involving Mirena complications since the IUD was first brought to market.*
According to court documents, plaintiffs in Mirena lawsuits are alleged to have suffered a number of serious injuries following spontaneous migration of the device, including uterine perforations, damage to other organs, infections, scarring, and ectopic pregnancy. The lawsuits accuse Bayer Healthcare Pharmaceuticals of downplaying the risk of Mirena complications and exaggerating its benefits. According to court records, at least 173 Mirena IUD lawsuits have been filed in the New Jersey litigation, while more than 100 similar claims are pending in the Southern District of New York.
