Mirena Lawsuits Move Forward, as Federal Court Preps for First Mirena Bellwether Trials in Late 2015, Bernstein Liebhard LLP Reports

According to a Scheduling Order issued on August 16, 2013, the Court has outlined a time-table for selecting Mirena IUD lawsuits for the litigation’s first bellwether trials, which could get underway in late 2015. Mirena IUD Lawsuits
According court documents, at least 123 Mirena lawsuits are currently pending in the Southern District of New York. All of these claims allege the Mirena IUD migrated away from its original position in the uterus, leading to uterine perforations and other serious Mirena complications. Plaintiffs further allege Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risk of device migration and related side effects. The litigation’s next Status Conference has been scheduled for September 26, 2013.
In addition to the claims pending in the federal multidistrict litigation, more than 180 Mirena IUD lawsuits involving similar allegations have been filed in a Multicounty Litigation now underway in Bergen County Superior Court in New Jersey. The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) for contraception in 2000, and in 2009 for the treatment of heavy menstrual bleeding in women who wish to use an IUD as their method of birth control. According to recent media reports, statistics from the FDA indicate that the agency has received thousands of reports of Mirena complications, including incidents of device migration and uterine perforation, since the IUD was first brought to market.*
In 2009, the FDA issued a warning letter to Bayer Healthcare Pharmaceuticals after finding that its promotions overstated the efficacy of the IUD and minimized the risk for Mirena complications. Among other things, the FDA cited marketing claims touting Mirena’s supposed benefits for a woman’s sex life, as well as its purported ability to help her “look and feel great.”
