Mirena lawsuits (http://www.filemirenalawsuit.com/) filed on behalf of women who allegedly suffered uterine perforations and other serious Mirena complications continue to move forward in a Multicounty Litigation underway in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports. According to a Pretrial Order dated August 23, 2013, the parties have approved a Plaintiff’s Fact Sheet, which will be used for all Mirena IUD lawsuits filed in the litigation. Mirena IUD Lawsuits
As of September 11, 2013, some 215 Mirena IUD lawsuits had been filed in the litigation underway in New Jersey. According to court documents, all of the complaints pending in the proceeding allege that Bayer Healthcare Pharmaceuticals failed to provide patients and doctors with adequate warnings regarding the risk of spontaneous device migration and related Mirena complications. Plaintiffs further allege that the company has a history of downplaying the serious risks associated with Mirena and exaggerating its purported benefits.

In addition to the Mirena lawsuits now pending in New Jersey, court records indicate at least 123 claims involving similar allegations have been filed in a federal multidistrict litigation now underway in U.S. District Court, Southern District of New York. According to a Scheduling Order issued in that proceeding on August 16, 2013, the Court has outlined a time-table for selecting Mirena IUD lawsuits for its first bellwether trials, which could get underway in late 2015. The Mirena IUD has been available for sale since 2000, and is approved as both a contraceptive and as a treatment for heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control. According to a recent report from 7 Action News in Detroit, some 2 million women now use Mirena. However, data from the U.S. Food & Drug Administration (FDA) indicates that since 2008, more than 4,700 Mirena users have experienced device dislocation, while at least 1,322 have suffered uterine perforations. Since 2000, more than 70,000 cases of Mirena complications have been reported to the agency’s adverse event database.*

In 2009, Bayer Healthcare Pharmaceuticals received an FDA Warning Letter, after the agency found that some materials used in one of its Mirena promotions overstated the benefits of the IUD and minimized the risk for Mirena complications. Among other things, the FDA cited marketing claims touting Mirena’s purported ability to improve a woman’s sex life, as well other benefits that could supposedly help her “look and feel great.”
