New York, NY (PRWEB) October 25, 2013
An order to transfer a Mirena lawsuit (http://www.themirenalawsuitcenter.com/) to the federal proceeding underway in the U.S. District Court, Southern District of New York has been vacated by a federal panel who decided that its claims were not factually similar to those already filed in the litigation, Bernstein Liebhard LLP reports.
According to an order issued on October 16th by the U.S. Judicial Panel on Multidistrict Litigation (JPML), the case will no longer be transferred because it fails to allege spontaneous migration of the IUD and/or uterine perforations; claims which are included in all other federally-filed Mirena lawsuits involved in the proceeding. A Motion to vacate the Panel’s order to transfer this complaint was originally filed by Bayer Healthcare Pharmaceuticals Inc.
Court records indicate that dozens of Mirena lawsuits alleging complications stemming from spontaneous migration of the IUD are currently pending in the federal New York litigation. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)
“Our Firm has received numerous inquiries from women who allegedly experienced the serious complications associated with Mirena. We are expecting many more Mirena lawsuit filings,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices, including the Mirena IUD is currently offering free and confidential case evaluations to potential Mirena lawsuit claimants who may have experienced injuries following implantation of the birth control device.
According to recent court records, some 159 federally-filed Mirena lawsuits are currently pending in the proceeding underway in the U.S. District Court, Southern District of New York. The next status conference in this litigation has been scheduled for November 21st at 9:30 a.m.
At least 219 Mirena lawsuits have also been filed in New Jersey’s Bergen County Superior Court. Cases involved in this consolidated proceeding similarly allege that the Mirena IUD was designed defectively by the manufacturer, given its potential to migrate away from the uterine wall and cause a host of serious complications. Actions against Bayer further allege that the company has a history of overstating the benefits associated with its product and downplaying the risks. On December 30th, 2009, the company received an FDA Warning Letter that pointed to certain promotions of Mirena, which the federal agency found to be misleading in claims about its safety and effectiveness.
After obtaining data from the U.S. Food & Drug Administration (FDA)’s database of adverse event reports, 7 Action News published a report in August 2013 indicating that over 70,000 Mirena complication reports had been filed since the IUD’s approval in 2000.* Thousands of complaints involving the IUD included instances of device dislocation and uterine perforation, according to the report.
Women who may have experienced Mirena complications may be eligible to receive compensation for injuries sustained after implantation of the birth control device.
