Mirena Lawsuits Mount, as Claims in Federal, State Litigations Surpass 800, Bernstein Liebhard LLP Reports

According to court documents filed in the U.S. District Court, Southern District of New York, at least 344 claims have been filed in the federal multidistrict litigation established for Mirena IUD lawsuits. According to a report that aired on 7 Action News this past summer, since its initial approval in 2000, the FDA has logged over 70,000 complaints involving Mirena side effects, including thousands that detail cases of device dislocation and uterine perforation.* In December 2009, the agency issued a Warning Letter to Bayer Healthcare Pharmaceuticals after it determined that a promotional campaign for the IUD made misleading claims about its benefits and the risk of Mirena complications.
According to court documents, all of the Mirena IUD lawsuits pending in New York and New Jersey allege that Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risks associated with the IUD. Among other things, plaintiffs claim that the Mirena label does not warn of the danger of spontaneous migration of the device, and only states that this could occur if the uterus is perforated upon insertion.
