Court records indicate that at least 100 Mirena lawsuits are currently pending in the Southern District of New York, all of which allege the IUD caused women to suffer serious complications, including infections and organ damage, after it perforated the uterus and migrated to other areas of the body. Plaintiffs further allege that Bayer Healthcare Pharmaceuticals has a history of overstating the benefits of the IUD and downplaying the risk of serious Mirena complications.
According to court documents, at least 173 additional Mirena IUD lawsuits involving similar allegations have been filed in New Jersey’s Bergen County Superior Court. The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) as a birth control method in 2000. In 2009, the agency cleared Mirena to alleviate heavy menstrual periods in women who wish to use an IUD as their primary method of birth control. According to recent media reports, more than 70,000 complaints involving Mirena complications have been logged with the FDA since the IUD was brought to market, including thousands of reports detailing device migration and uterine perforations.* In 2009, Bayer received an FDA Warning Letter which cited a Mirena promotional campaign for making misleading claims about the purported benefits of the IUD and its potential side effects.
