Mirena Lawsuits Continue to Mount as Claims in New Jersey Litigation Surpass 200, Bernstein Liebhard LLP Reports

According to a report from 7 Action News in Detroit, thousands of Mirena complications have been logged by the U.S. Food & Drug Administration’s (FDA) adverse event database, including more than 4,700 reports of device dislocation and 1,322 instance of uterine perforation since 2008.*
According to court documents, plaintiffs who have filed Mirena lawsuits in the New Jersey litigation accuse Bayer Healthcare Pharmaceuticals of failing to provide patients and doctors with adequate warnings regarding the risk of spontaneous device migration and related Mirena complications. These lawsuits further claim that Bayer has downplayed the IUD’s serious risks, and overstated its benefits. Among other things, plaintiffs point out that Bayer received an FDA Warning Letter in 2009 that raised similar concerns about one of the company’s Mirena promotions.
Court records indicate at least 123 additional Mirena IUD lawsuits involving similar allegations have been filed in a federal multidistrict litigation now underway in U.S. District Court, Southern District of New York.
