Bernstein Liebhard LLP Notes Upcoming Status Conference in New Jersey Mirena Lawsuit Litigation, Where More than 630 Cases Have Now Been Filed
New York, NY (PRWEB) March 08, 2014 -- A Mirena lawsuit (http://www.themirenalawsuitcenter.com/) litigation that now includes more than 630 cases over the IUD is looking ahead to its April status conference, Bernstein Liebhard LLP reports.
According to recent documents, the next Case Management Conference in the multicounty proceeding has been scheduled for April 1, 2014 in New Jersey’s Bergen County Superior Court. Individuals serving as Liaison Counsel have been instructed to meet at 1:00 p.m. on that date, with all other counsel expected to appear at 2:00 p.m. At this Court meeting, parties will discuss matters related to Mirena IUD lawsuits that have been filed by women who allege spontaneous migration of the contraceptive device, perforation of the uterus and other complications following proper insertion by a health care provider. A Case List posted February 25th on the Court’s website indicates that 636 claims have now been filed in the litigation against Bayer Healthcare Pharmaceuticals, the IUD’s manufacturer. Court documents show continued progress in federal and state-coordinated Mirena IUD lawsuit litigations, with more than 1,000 claims now filed in the U.S. In addition to claims now pending in New Jersey Superior Court, a Case List updated on February 19th by the U.S. Judicial Panel on Multidistrict Litigation (JPML) indicates that 408 Mirena lawsuits have been filed in New York federal court by women who used the implant as their method of contraception. Cases now pending in the U.S. District Court, Southern District of New York allege Bayer failed to adequately test the device for safety and effectiveness before bringing it to market in 2000, after which time women were not adequately warned about its potential problems. According to claims, Mirena IUD complications may include spontaneous device migration, ectopic pregnancy, infection, organ damage and perforation of the uterus. A Warning Letter sent by the U.S. Food and Drug Administration (FDA) in 2009 scolded the company for such behavior after finding certain marketing claims about the IUD to be misleading.
