Bernstein Liebhard LLP Reports on a New Mirena Lawsuit Order Issued in New Jersey, Where 700 Claims Have Now Been Filed over IUD

According to court documents, the Case Management Order announced on April 1st, 2014 approves a short form commission process for obtaining out-of-state discovery in claims centralized in the litigation. A Case List posted on the Court’s website the next day showed 703 Mirena lawsuits now filed in New Jersey on behalf of women who allege spontaneous migration of the birth control device, as well as uterine perforations and other complications that followed insertion by a healthcare provider. Mirena IUD Lawsuits
Included in more than 700 claims filed in New Jersey’s Bergen County Superior Court are allegations that spontaneous migration of the Mirena IUD may lead to organ damage, vaginal scarring, ectopic pregnancy and other complications. According to plaintiffs, Mirena’s labeling only notes its potential to migrate if the uterus has perforated during implantation, but not its possibility to move away from the uterine wall after proper insertion by a healthcare provider. Women in these cases go on to claim that the IUD was negligently designed, manufactured and marketed by its manufacturer, Bayer Healthcare Pharmaceuticals, Inc., who allegedly failed to adequately warn patients and their doctors about risks that may be associated with its product.

Women in these cases similarly allege that Bayer has a history of downplaying the side effects of Mirena from the general public, and was admonished for doing so in 2009 by the U.S. Food and Drug Administration (FDA). According to a Warning Letter issued that year, certain promotions of the IUD contained misleading marketing claims about its safety and effectiveness.
The Mirena IUD was approved by the U.S. Food and Drug Administration (FDA) in 2000 as a contraceptive. Its list of approved uses later expanded in 2009 to include the treatment of heavy menstrual bleeding in women who used it for birth control. Since its launch into the U.S. market, an investigation led by 7 Action News in Detroit found in August 2013 that 70,000 Mirena complications reports have been filed with the FDA since 2000. Several instances of device dislocation and uterine perforations were noted in these complaints, according to the report.*
