Bernstein Liebhard LLP Notes Issuance of New Mirena Lawsuit Order in New Jersey Superior Court Litigation
New York, NY (PRWEB) April 12, 2014 -- A consolidated Mirena lawsuit (http://www.themirenalawsuitcenter.com/) litigation in New Jersey has issued a new Order this week, the latest pertaining to the personnel files of witnesses noticed for depositions in the litigation, Bernstein Liebhard LLP reports.
According to an Order filed on April 8th, 2014, the state court judge overseeing IUD-related cases in Bergen County Superior Court has directed Bayer Healthcare Pharmaceuticals to produce certain portions of witness’ personnel files seven days prior to a deposition. The Order, which relates to any domestic Mirena lawsuit witness deposed in the litigation, requires Bayer to submit any performance reviews, evaluations, or any information related to their termination from the company, to name a few of the requirements set forth by the court. Mirena Lawsuits
Court documents show continued progress in the Mirena lawsuit proceeding now pending in Bergen County Superior Court. As of April 2, 2014, more than 703 cases over the IUD had been filed in the consolidated litigation by women who allege similar complications caused by the birth control implant. These may include but are not limited to: spontaneous device migration, ectopic pregnancy, infection, organ damage, uterine perforations and vaginal scarring, according to claims. All the lawsuits filed in this proceeding similarly allege that Bayer Healthcare Pharmaceuticals failed to adequately warn women and their doctors about risks associated with Mirena, which they say was defectively designed given its alleged association with complications.
In addition to IUD lawsuits filed in New Jersey, court records from March 2014 show more than 400 cases pending in a federal litigation underway in the U.S. District Court, Southern District of New York. Plaintiffs in these cases similarly allege damages stemming from spontaneous migration of the device. Bayer has a long-standing history of overstating the benefits of Mirena, and downplaying its potential for side effects. The company was reprimanded by the U.S. Food and Drug Administration (FDA) for doing so in 2009, when they received a Warning Letter that took issue with certain marketing claims overstating the IUD’s safety, as well as its ability to prevent pregnancy, according to claims filed in this proceeding. Mirena was approved by the FDA in 2000 as a contraceptive, and was later cleared in 2009 to treat heavy menstrual bleeding in women who used it as their method of birth control.
