Mirena lawsuit claims pending in a federal multidistrict litigation now underway in U.S. District Court, Southern District of New York, continue to mount, Bernstein Liebhard LLP reports. According to a July 10th update issued by the U.S. Judicial Panel on Multidistrict Litigation (JPML), more than 105 Mirena side effects lawsuits have been transferred to the Southern District of New York since the multidistrict litigation was established by the JPML this past April. The Mirena IUD is a long-acting birth control device that is inserted into the uterus by a healthcare professional, where it can remain for up to five years. However, since its launch in 2000,over 70,000 Mirena side effects reports have been made to the U.S. Food & Drug Administration (FDA), including thousands of reports of device dislocation and uterine perforations.*
All of the Mirena lawsuits pending in the Southern District of New York allege Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the potential for spontaneous device migration and related complications, including uterine perforations, embedment in the uterine wall, scarring, infections, and ectopic pregnancy. In addition to the federal claims, some 170 Mirena side effect lawsuits that involve similar allegations have been filed in a Multicounty Litigation now underway in New Jersey’s Bergen County Superior Court.
