According to an updated docket report issued by the U.S. Judicial Panel on Multidistrict Litigation on February 19, 2014, at least 408 such claims have been filed in a multidistrict litigation underway in U.S. District Court, Southern District of New York. Mirena Lawsuit Allegations
The Mirena IUD is a small t-shaped device made of flexible plastic that is inserted into a woman’s uterus, where it can remain for up to five years. The U.S. Food & Drug Administration (FDA) first approved the device as a method of contraception in 2000, and expanded its uses in 2009 to include the treatment of heavy menstrual bleeding in women who wish to use an IUD. That same year, the FDA issued a warning letter to Bayer Health Care Pharmaceuticals for a Mirena promotion the agency said made misleading claims about the benefits associated with the IUD, and downplayed the potential for serious Mirena side effects.
According to court documents, all of the Mirena lawsuits now pending in the state and federal litigations similarly allege that recipients of the IUD suffered uterine perforations and other serious Mirena side effects following spontaneous device migration. The lawsuits claim that Bayer failed to provide adequate warnings regarding this risk, and only cautioned that migration could occur if the uterus was perforated upon insertion.
