Mr. Fertig brings more than 20 years of experience representing companies and their C-suite executives in complex, high-stakes disputes, both in U.S. state and federal courts and in U.S. and international arbitration proceedings. His joining Morrison & Foerster also highlights the continued growth of the firm's New York office over the last 12 months, following the arrival of six other lateral partners.
Mr. Fertig's trial and arbitration practice spans the full range of commercial litigation and counseling, including matters related to contract and intellectual property issues, fraud and other business torts, antitrust, labor and employment laws, and bankruptcy, real estate and insurance litigation. He advises companies in a wide range of industries, with significant experience in the technology, life sciences, media and entertainment, private equity, financial services, information, infrastructure, retail, real estate and insurance sectors.

Representative high-profile matters in which Mr. Fertig has either first chaired or delivered successful outcomes before trial include securing a multimillion dollar arbitration award on behalf of a global pharmaceutical company following a private ad hoc arbitration concerning royalties payable under a license agreement relating to the use of certain patented technology in a combination drug and delivery device product; securing summary judgment in favor of one of the world's largest private equity firms in a nationwide antitrust class action alleging that the firm had conspired with ten other renowned private equity firms and investment banks to illegally suppress the prices paid to shareholders in some of the largest leveraged buyouts in history through the use of horizontal agreements to allocate deals, rig auction bids and refrain from competition with one another; representing the financial division of an American multinational conglomerate in multidistrict litigation proceedings arising out of an alleged multimillion dollar fraudulent investment scheme involving the purported sale and lease of commercial equipment; and securing an injunction for a major healthcare cost containment provider against a competitor and several former employees who staged an en masse departure in connection with the competitor's efforts to re-enter the market following the sale of its business to the provider.
