According to a federal lawsuit news article on, DePuy Orthopaedics recently reached a new settlement to cover 1,400 more claimants who filed lawsuits nationwide for defective hip replacement parts. Persons who have suffered as a result of defective DePuy hip implant components between August 13, 2013 and January 31, 2015 are eligible to file claims through May 1, 2015. The new settlement is expected to total approximately $420 million.

A first settlement of $2.5 billion was announced in 2013, providing settlements to roughly 8,000 plaintiffs involved in DePuy hip recall lawsuits for defective hip replacement parts. The lawsuits were consolidated as a multidistrict litigation (MDL), based on common allegations of defects in the recalled metal-on-metal hip replacement parts.

DePuy Orthopaedics, a subsidiary of Johnson & Johnson, recalled over 90,000 hip replacement systems in 2010 after research showed the device was prone to early failure, requiring revision surgery to remove and replace the faulty parts.

Should the payout specifications remain the same, claimants in the new DePuy hip replacement settlement can expect to receive $250,000 - $300,000 apiece. Persons who were required to undergo more than one revision surgery, or who missed work as a result of the defective parts, may expect settlements at the higher end of this range. Claimants who are significantly overweight may anticipate lower claims as obesity is a risk factor for early joint failure.
