DrugRisk Alerts of Judicial Update as NuvaRing Lawsuits Show Increase

A judge recently ruled patients alleging blood clot injuries can seek punitive damages as the number of lawsuits has increased in recent months*.

Health experts have linked contraceptives like NuvaRing to higher risks of blood clots than traditional birth control pills. Last year, the New England Journal of Medicine published a study finding vaginal ring contraceptives could relate to a 2.5 to 3-fold increased risk of blood clots**.
So far, nearly 1,100 patients have filed a NuvaRing lawsuit alleging blood clots in a special federal court in Missouri. The formal case is known as In re: NuvaRing Products Liability Litigation, No. 08-md-1964, JPML, Eastern District Missouri. Hundreds more have been filed in a New Jersey multi-district court (In re: NuvaRing Litigation (BER-L-3081-09, Superior Court of New Jersey, Bergen County)).
The resource center has learned that the latest court records show the number of claims has increased from 1,097 on March 5th to 1,163 as of May 15th, an increase of over 6%***. The first trial for these lawsuits has been scheduled to start in October****.
Now, DrugRisk has added information that Judge Brian R. Martinotti, of the New Jersey court, ordered that patients can seek punitive damages against the maker of the device for alleged blood clot injuries*. However, DrugRisk cautions this is not an indication of the success or failure of any particular case.
