The controversy involving power morcellators (http://www.morcellatorlawsuit2015.com) and their potential to spread uterine cancer was featured on a segment that aired on the popular Dr. Oz Show on September 24, 2014, Bernstein Liebhard LLP reports. During the broadcast, the dean of the Temple University School of Medicine and chief of Temple University Hospital discussed that institution’s decision to ban the use of uterine morcellation because of these safety issues. Dr. Oz also spoke to a woman who was diagnosed with uterine cancer following such a procedure, who told the audience that she expected to prematurely die from the disease. At the end of the segment, Dr. Oz said he felt compelled to advocate against the use of uterine morcellation at this time because of the possible dangers associated with such surgeries.*
“Our Firm has been contacted by a number of women who allegedly experienced the spread of uterine cancers, allegedly due to power morcellators. We are pleased that this issue is receiving the attention it deserves,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is now evaluating potential morcellator lawsuits on behalf of women who may have experienced the spread of undiagnosed uterine sarcoma and other cancers due to uterine morcellation.
Uterine Morcellation and Cancer
Power morcellators are used in laparoscopic hysterectomies and fibroid removals to shred tissue so that it can be easily removed through a small incision in the abdomen. In April, the U.S. Food & Drug Administration (FDA) warned that use of the devices in gynecological procedures could spread undetected uterine cancer cells throughout a woman’s body. The FDA stated that roughly 1 in 350 women with fibroids actually has undiagnosed uterine sarcoma, and that dissemination of those cancer cells outside of the uterus can greatly reduce a woman’s chances for long-term survival.
Since the FDA announcement, Johnson & Johnson’s Ethicon, Inc. unit announced that it was withdrawing its Gynecare Morcellex, Gynecare X-Tract and Morcellex Sigma morcellator systems from the market because the risks and benefits associated with such devices remain uncertain.**
Women who allegedly experienced the spread of uterine cancer due to a power morcellator may be entitled to compensation for their medical bills, lost wages, pain and suffering, and other injury-related damages.
