Pradaxa Lawsuit News: Bernstein Liebhard LLP Notes Federal Judge’s Refusal to Dismiss Certain Claims in Pradaxa Lawsuit

According to court documents filed in the U.S District Court, Southern District of Illinois, the judge overseeing the federal Pradaxa litigation has refused to dismiss claims in one lawsuit based on alleged violations of the Food, Drug and Cosmetic Act (FDCA). In doing so, U.S. District Judge David Herndon noted that the five plaintiffs named in the Pradaxa lawsuit had not filed their lawsuit directly under the Act. Rather, the alleged FDCA violations referred to in their claim appeared to be offered in order to establish the duty Boehringer Ingelheim allegedly failed to meet in relation to the state law claims put forth in the complaint. Pradaxa Bleeding Allegations
This Pradaxa lawsuit is just one of at least 2,086 currently pending in the Southern District of Illinois, all of which allege use of the blood thinner caused patients to experience dangerous and sometimes fatal episodes of internal hemorrhaging, including cerebral and gastrointestinal bleeding, The lawsuits further allege that Boehringer Ingelheim failed to provide patients and doctors with adequate warnings about these risks, including the fact that there currently exists no readily-available antidote to stop Pradaxa bleeding. According to a report issued by the Institute for Safe Medicine Practices in October, Pradaxa was associated with more adverse events in 2012 than any other drug monitored by the U.S. Food & Drug Administration (FDA). That year the FDA received more than 3,200 reports involving Pradaxa, including over 580 that had fatal outcomes. By contrast, warfarin, a blood thinner that’s been on the market for decades, was the named in only 861 incident reports, including 56 deaths.*
The FDA recently announced that it would conduct a large-scale study of Pradaxa bleeding rates in order to compare “selected safety outcomes in adults with atrial fibrillation who are new users of dabigatran or warfarin.”
