Robotic Surgery Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Filing of Removal Notice in Pennsylvania Da Vinci Robot Lawsuit

According to court documents, Intuitive Surgical, the manufacturer of the robotic surgery system, has filed a Notice of Removal with the U.S. District Court, Eastern District of Pennsylvania, seeking to have a da Vinci lawsuit filed in the Pennsylvania Court of Common Pleas transferred to federal court. In the August 19th Notice, Intuitive asserts that the transfer is appropriate because the Plaintiffs are likely to seek damages in excess of what is allowed in the state court, and because the parties are citizens of different states, giving the federal court subject matter jurisdiction over the da Vinci robot lawsuit. Da Vinci Lawsuit Allegations
The da Vinci Surgical System was brought to market in 2000 by Intuitive Surgical, Inc., and is the only robotic surgery platform approved in the U.S. for soft tissue procedures. According to a study published in June in the Journal of the American Medical Association, an increasing number of men with low risk prostate cancer are choosing to undergo robotic prostatectomy, even though these types of procedures may not offer patients any added benefits. The same study also found that robot-assisted procedures are far more expensive compared to traditional forms of surgery and radiation.
In July, an Intuitive Surgical regulatory filing disclosed that the company had been named in 33 individual da Vinci robot lawsuits filed in various state and federal courts that allege use of the robotic surgical system caused patients to suffer serious, and in some cases fatal, injuries. Intuitive also disclosed that it had entered into tolling agreements in some of these cases, “in an effort to provide an orderly process for evaluating claims before they result in costly litigation.” *
