Shiver Hamilton, an Atlanta-based personal injury law firm, recently settled a lawsuit against a Florida corporation and its employee for just under $5,000,000.00. The settlement involved layering the insurance coverage of three different insurance policies.
The complaint was filed in the Northern District of Georgia. The decedent’s widow was the Plaintiff in the lawsuit. Plaintiff alleged that the defendant, an employee of a Florida corporation, crossed the centerline and struck a South Georgia resident at high speeds. The Georgia man later died from injuries sustained in the collision. The at-fault driver was in Georgia doing business on behalf of the Florida corporation. Plaintiff alleged that the corporation was legally responsible for the negligence of its employee while he was acting on behalf of the corporation.
In its Answer to Plaintiff’s Complaint, the corporate Defendant denied that its’ employee was negligent and that it was vicariously responsive for the employees acts or omissions. Shiver Hamilton subpoenaed receipts, emails, cell phone records and other documents to prove that the company was responsible for the wreck and tragic death of Plaintiff’s husband.
The company offered an initial settlement of $1,100,000.00 which was declined. As the firm was preparing to take the case to a jury trial, the Defendants substantially increased their offer, and Shiver Hamilton settled the case for $4,950,000.00.
