Attorney Steven Adair MacDonald, founder of Steven Adair MacDonald & Partners, recently won a jury trial lasting over a week (Case No. CUD-16-657330 filed in the Superior Court of California City and County of San Francisco) for a 92-year-old landlady (plaintiff) where a “nuisance” tenant was evicted from her two-unit building. According to court documents, the defendant continuously disturbed the comfort, safety and enjoyment of other tenants in the building. This was the first time the plaintiff has had to evict a tenant since buying the building in the 1960’s. “It’s so sad,” said Mr. MacDonald. “This tenant really brought this upon herself.”
Court documents further state that the defendant allowed her adult children and their guests (who were not residents of the building) to live in and use the building’s shared two-car garage, where they allegedly engaged in illegal drug use, thus placing other tenants at risk and subjecting them to repeated instances of loud and objectionable conduct. They also allegedly engaged in a pattern of intimidation and harassment directed at other tenants that caused them to fear for their personal safety.
Court documents further allege that the defendant’s actions were so severe that the only other set of tenants in the building terminated their lease with the plaintiff, an Italian immigrant who worked as a seamstress for years to save enough money to purchase the building.
