Our Firm is representing numerous individuals who have filed lawsuits against Stryker and DePuy over allegedly defective hip implant.
New York, New York (PRWEB) November 29, 2014
As thousands of people throughout the U.S. pursue DePuy Pinnacle and Stryker hip lawsuits (http://www.consumerinjurylawyers.com/stryker-rejuvenate/stryker-hip-lawsuits/) for complications they allegedly suffered due to defective metal hip components, Bernstein Liebhard LLP notes that a prominent patient advocacy group has called on device manufacturers to provide recipients of artificial joints with warranties that would cover costs for replacement in the case of device failure. According to a report from The Journal Gazette that details the proposal put forth by the Consumers Union, a number of hip manufacturers including DePuy Orthopaedics and Stryker have dealt with defective device issues in recent years. The group contends that patients should not have to bear the financial burden for revision surgery to replace faulty hip and knee implants.*
“Our Firm is representing numerous individuals who have filed lawsuits against Stryker and DePuy over allegedly defective hip implants. In addition to the costs associated with revision surgery, many of these patients have also incurred damages related to lost wages, pain and suffering, and permanent disability,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm continues to offer free case evaluations to individuals who have suffered serious complications, allegedly due to failed Stryker and DePuy hip implants.
Hip Implant Litigation
Stryker Rejuvenate and ABG II hip stems were subject to a global recall in July 2012, after post-market surveillance data indicated the metal components were prone to fretting and corrosion at the modular neck junction.** Since then, thousands of people have filed product liability lawsuits against Stryker for injuries they allegedly sustained due to their failure. These cases include more than 2,160 cases that are pending in New Jersey’s Bergen County Superior Court, where Bernstein Liebhard LLP is actively filing claims. (In Re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296) An additional 2,179 Stryker hip lawsuits that put forth similar allegations have been filed in a federal multidistrict litigation underway in U.S. District Court, District of Minnesota. (In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, No. 244)
On November 3, 2014, a Stryker hip settlement program was announced in Bergen County Superior Court, which could ultimately resolve thousands of state and federal claims involving Rejuvenate and ABG II hip stems. According to court documents, the settlement provides for gross base awards of $300,000 per failed implant, with potential deductions and enhancements based on the particulars of each case, including additional compensation for claimants who suffered complications during revision surgery and for other damages, including future surgeries caused by complications. The settlement also provides compensation for individuals who need a revision but are medically unable to undergo the surgery. Claimants may begin receiving their awards by the summer of 2015.
Court documents also indicate that more than 6,900 DePuy Pinnacle hip lawsuits involving a metal-on-metal version of the device that utilizes the Ultamet liner are currently pending in a federal multidistrict litigation underway in U.S. District Court, Northern District of Texas. All of the claims similarly allege that the all-metal design created by this configuration makes the hip implant prone to premature failure and other complications, including metallosis (metal ion poisoning) and chronic pain. Jeffrey S. Grand, a partner with Bernstein Liebhard LLP, is serving on the Plaintiffs’ Steering Committee for the federal proceeding. (In re: DePuy Orthopaedics Inc. Pinnacle Hip Implant Product Liability Litigation, MDL No. 2244)
Victims of serious injuries allegedly caused by the metal-on-metal DePuy Pinnacle hip implant or Stryker’s Rejuvenate and ABG II hip stems may be entitled to compensation for medical bills, lost wages, pain and suffering, and more.
