Stryker Hip Lawsuit News: Bernstein Liebhard LLP Notes Issuances of First Pretrial Order in Federal Stryker Hip Recall Litigation
New York, NY (PRWEB) July 09, 2013 -- Stryker hip lawsuit claims stemming from last year’s recall of Rejuvenate and ABG II Modular-Neck Hip Stems have begun to move forward in the federal multidistrict litigation recently established in U.S. District Court, District of Minnesota. On July 5th, the Court issued the proceeding’s first Pretrial Order, which among other things, establishes preliminary procedures for the litigation. The Order also noted that the Court would hold the first Status Conference in the Stryker hip recall litigation on a date in August 2013, which will be set in a separate Order to be issued by the Court later this month. Stryker Hip Replacement Lawsuits
The federal Stryker hip recall litigation was established in June by the U.S. Judicial Panel on Multidistrict Litigation. According to the Panel’s June 12th Transfer Order, 41 Stryker hip replacement lawsuits were initially transferred to the District of Minnesota for discovery and other pretrial proceedings. However, the Order noted that an additional 110 potentially-related Stryker hip recall claims were also pending in various federal district courts that could also be eligible for transfer to the multidistrict litigation. Court records also indicate that more than 160 Stryker hip lawsuits have been consolidated in a Multicounty Litigation now underway in New Jersey’s Bergen County Superior Court. (In re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296) All of the claims pending in these proceedings allege recipients of the Rejuvenate and ABG II hip stems suffered serious complications, including metallosis and premature device failure, due to fretting and/or corrosion of the devices at or about the modular-neck junction.
The Stryker hip recall for Rejuvenate and ABG II hip stems was announced in July 2012, after the components were found to be prone to fretting and corrosion at the modular-neck junction. Stryker has advised that all patients affected by the Rejuvenate and ABG II hip stem recall undergo blood tests for elevated metal ion levels and cross sectional imaging to ensure the components are functioning properly. According to the company, some Stryker hip recipients have experienced elevated metal ion levels and adverse local tissue reactions, even in the absence of any symptoms.*
