According to a new case list issued by the Court on November 18, 2013, 553 Stryker hip lawsuits have been filed in a multicounty litigation underway in New Jersey’s Bergen County Superior Court on behalf individuals who were allegedly injured by Rejuvenate and ABG II hip stems. Stryker Hip Recall
Stryker announced the Rejuvenate and ABG II hip stem recall in July 2012, after post-market data indicated the metal components were vulnerable to a high rate of fretting and corrosion at the modular neck junction, placing recipients at risk for pain, swelling, adverse local tissue reactions, and premature failure of their hip implant. Stryker has advised all Rejuvenate and ABG II patients to undergo imaging and blood tests to ensure their hips are functioning properly, even if they are not experiencing any symptoms that would indicate otherwise. According to the Stryker recall notice, some Rejuvenate and ABG II recipients who presented without symptoms have nevertheless suffered adverse local tissue reactions and elevated levels of metal ions in their blood.*
Since the recall was announced, court documents indicate that hundreds of Rejuvenate and ABG II patients have filed Stryker lawsuits seeking compensation for injuries allegedly caused by the devices. In addition to the cases pending in New Jersey State Court, court documents show that at least 395 Stryker recall claims have been filed in a federal multidistrict litigation underway in U.S. District Court, District of Minnesota.( In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, MDL No. 2441) All of the lawsuits involve similar allegations involving the propensity of the Rejuvenate and ABG II components to shed dangerous amounts of metal ions into recipients’ tissue and blood stream, which the complaints claim can cause metallosis, adverse local tissue reactions, necrosis, osteolysis, and failure of the hip.
