According to court documents, 797 Stryker hip lawsuits were filed in Bergen County Superior Court as February 25, 2014. All of the claims involve similar allegations regarding the propensity of the Rejuvenate and ABG II hip stems to fret and corrode, and to cause recipients to experience osteolysis, tissue necrosis, and other complications that necessitate replacement of the device. Court records in the proceeding indicate that nine of the ten Stryker hip recall claims chosen for early mediation have completed the process, with eight of the nine matters having been resolved through mediation. The court is preparing to begin Phase II of the early mediation process.
In addition to the claims pending in New Jersey, court records show that more than 570 federally-filed Stryker hip lawsuits involving similar allegations have been filed in a multidistrict litigation now underway in the U.S. District Court, District of Minnesota. Stryker recalled its Rejuvenate and ABG II hip stems in July 2012, after the company determined that the metal hip stems could fret and corrode at the at the modular-neck junction. Stryker has recommended that all Rejuvenate and ABG II recipients undergo blood and imaging tests to ensure their hip stems are functioning properly, even if they have not experienced any symptoms related to a failing hip implant.*
