Stryker Hip Lawsuit News: Defendant Opposes Motion to Compel Document Production in Federal Stryker Hip Litigation, Bernstein Liebhard LLP Reports

According to a brief filed in the U.S. District Court, District of Minnesota on April 4, 2014, Howmedica Osteonics Corp., a defendant in Stryker hip recall claims, is opposing a motion to compel the production of certain documents and answers to interrogatories sought by plaintiffs with cases pending in the District. The brief asserts that plaintiffs have not explained why the information they are seeking is important to their claims. Stryker Hip Recall Litigation
In 2012, Stryker recalled Rejuvenate and ABG II hip stems after post-market data indicated that an unacceptable number of recipients were experiencing pain, adverse local tissue reactions, and device failure due to fretting and corrosion at the modular-neck junction. At the time of the recall, some 20,000 of the affected hip stems were sold globally, but it is not known how many were implanted in patients. Stryker has recommended all patients who received a Rejuvenate or ABG II hip stem undergo blood and imaging tests to ensure their device is functioning properly, even if they have not experienced any symptoms related to a failing hip implant.*
According to court documents, more than 950 Stryker hip lawsuits stemming from the 2012 recall have been filed in a multicounty litigation underway in New Jersey’s Bergen County Superior Court, where Bernstein Liebhard LLP is currently filing claims. All of the complaints allege that the Rejuvenate and ABG II hip stems were defectively designed and manufactured, and caused recipients to suffer osteolysis, tissue necrosis, adverse local tissue reactions, and other debilitating complications. The lawsuits further allege that many affected by the Stryker hip recall continue to suffer from pain and disability, even after undergoing surgery to remove and replace their failing devices. In addition to the claims pending in New Jersey, court documents indicate that more than 600 Stryker hip lawsuits involving Rejuvenate and ABG II hip stems have been consolidated in the federal multidistrict litigation now underway in U.S. District Court, District of Minnesota.
