Stryker Hip Settlement News: Court Order Requires Registration of All Potential Stryker Hip Recall Claims, Bernstein Liebhard LLP Reports

Matters relating to the recently-announced Stryker hip lawsuit ( settlement agreement continue to move forward in courts around the country, Bernstein Liebhard LLP reports. According to an Order issued on November 13, 2014 in New Jersey’s Bergen County Superior Court, all potential Stryker hip recall claims must be registered by December 14, 2014. The Order, which was issued in cooperation with the Stryker hip recall litigation underway in U.S. District Court, District of Minnesota, as well other state courts, applies to both filed and un-filed Stryker hip lawsuits, as well as claims for Rejuvenate and ABG II hip stem recipients who have not yet required revision surgery. Among other things, the November 13th Order notes that that registration in no way commits any claimant to enroll in the Stryker hip lawsuit settlement program. Following registration, those claimants who do wish to accept the terms of the settlement must enroll in the program between January 15, 2015 and March 2, 2015.

Stryker Hip Litigation
Stryker announced a worldwide recall for Rejuvenate and ABG II hip stems in July 2012, after the metal components were found to be vulnerable to fretting and corrosion at the modular-neck junction. Since then, court documents indicate that more than 5,000 Stryker hip lawsuits have been filed in U.S. courts on behalf of individuals who suffered complications allegedly associated with the devices. This includes more than 2,148 claims pending in New Jersey, as well as at least 2,148 Stryker hip lawsuits that have been filed in the District of Minnesota. The Stryker hip settlement program was announced in Bergen County Superior Court on November 3, 2014, and could resolve the thousands of Rejuvenate and ABG II lawsuits now pending in state and federal courts throughout the U.S. According to court documents, the global settlement program provides for gross base awards of $300,000 per failed implant, with potential deductions and enhancements based on the particulars of each case, including additional compensation for claimants who suffered complications during revision surgery and for other damages, including future surgeries caused by complications. The settlement also provides compensation for individuals who need a revision but are medically unable to undergo the surgery. Claimants may begin receiving their awards by the summer of 2015.

There is no overall cap or fixed fund for Stryker’s liability under this settlement program. According to the Associated Press, Stryker has disclosed that it will pay at least $1.43 billion to fulfill the terms of the agreement.**
