Stryker Hip Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Upcoming Conference in Stryker Rejuvenate Recall Litigation Underway in New Jersey
New York, New York (PRWEB) July 16, 2013 -- The New Jersey Multicounty Litigation established in Bergen County Superior Court for all Stryker hip lawsuit claims filed in the wake of last year’s recall for Rejuvenate and ABG II Modular Neck Hip Stems is moving forward, Bernstein Liebhard LLP reports. According to court documents, the litigation’s next Case Management Conference is scheduled for July 17th at 10:00 a.m. (In re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296)

Stryker Rejuvenate Recall
Stryker recalled its Rejuvenate and ABG II hip stems in July 2012, after the metal components were found to be prone to fretting and corrosion at the modular neck junction. All patients affected by the Stryker Rejuvenate recall have been advised by the company to undergo medical screening, including metal ion testing and cross-sectional imaging, to ensure their hip components are working properly. According to Stryker, patients fitted with Rejuvenate and ABG II stems may be at risk for adverse local tissue reactions characterized by pain and swelling around the hip joint. However, some patients have reportedly suffered adverse local tissue reactions in the absence of any symptoms.*
As of July 9th, at least 161 Stryker hip lawsuits were pending in the New Jersey litigation. Plaintiffs who have filed claims in the proceeding have allegedly suffered a number of serious complications due to fretting and corrosion of the recalled hip implants, including metallosis, necrosis and osteolysis,. In April, Bergen County Superior Court Judge Brian R. Marinetti set forth procedures for the parties to begin selecting cases for early mediation. However, his order stipulated that the case against Stryker will continue while mediation takes place.
According to court documents, dozens of additional Stryker hip replacement recall claims have been transferred to a federal multidistrict litigation now underway in U.S. District Court, District of Minnesota. According to a Pretrial Order dated July 5th, the Court has established preliminary procedures for that litigation. The Order also noted that the proceeding’s first Status Conference would be held in August, though the date has yet to be determined.
