Stryker Hip Lawsuits Update: Pretrial Proceedings Move Along in New Jersey Court, Rottenstein Law Group LLP Reports

Judge Brian R. Martinotti’s order says that defendant Stryker Corp. has until Jan. 31 to produce a fact sheet related to fact sheets plaintiffs in the New Jersey state consolidation already submitted, according to court documents (In re: Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation; MCL-296, Bergen County Superior Court, New Jersey). There are currently more than 500 lawsuits pending in the consolidation of cases in state court, also known as a “multicounty litigation.”
“Efficiency in pretrial proceedings becomes especially important when there are hundreds—or thousands—of plaintiffs. In simple cases, inefficiency won't derail the lawsuit. In a multidistrict litigation, however, small inefficiencies can quickly become large ones, and large inefficiencies can delay resolution by months or years,” said Rochelle Rottenstein, principal of the Rottenstein Law Group LLP.
Metal-on-metal hip implantees are filing Stryker lawsuits alleging that the company’s hip implant products, the Rejuvenate and the ABG II (both recalled in July 2012) cause serious side effects such as metal poisoning and device failure, according to court documents. The U.S. Food and Drug Administration has issued a warning about metal-on-metal hip implants that supports these allegations.*
Settlements
On Dec. 16, Stryker agreed to settle four hip lawsuits in New Jersey state court, according to court documents. This followed news that Stryker had set aside between $700 million and $1.1 billion for litigation expenses, according to an Oct. 23 Wall Street Journal article.**
