Stryker Hip Recall Claims Move Forward With Issuance of New Case Management Order in New Jersey Litigation, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) July 24, 2013 -- Stryker hip recall lawsuits alleging injuries due to Stryker’s recalled Rejuvenate and ABG II Modular Neck Hip Stems continue to move forward in a Multicounty Litigation underway in New Jersey’s Bergen County Superior Court. According to an Order dated July 23, 2013, the Court conducted a Case Management Conference on July 17th, at which time discovery and a proposed protective order were among the issues addressed. The Court also scheduled the litigation’s next Case Management Conference for August 13th at 10:30 a.m. (In Re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296)
“We are pleased to see this litigation moving forward, as we are representing a number of Stryker hip recall clients in the proceeding. We also continue to receive inquiries from Rejuvenate and ABG II recipients seeking information about Stryker hip lawsuits,” says Bernstein Liebhard LLP, a nationwide law firm representing the victims of defective drugs and medical devices. The Firm continues to offer free legal evaluations to individuals who have allegedly suffered serious complications that may be associated with the Stryker hip recall.
Stryker Hip Recall Lawsuits
According to a Case List issued by the Court on July 23rd, 273 Stryker hip lawsuit claims are now pending in the litigation underway in Bergen County Superior Court. All of the claims allege that the Rejuvenate and ABG II components caused recipients to suffer serious complications, including metallosis and premature device failure, due to fretting and corrosion at the modular neck junction.
At least 159 additional Stryker hip recall claims have been filed in a federal multidistrict litigation now underway in U.S. District Court, District of Minnesota. According to a Pretrial Order issued on July 22nd, the Court will conduct the litigation’s Initial Status Conference on September 9, 2013 at 1:30 p.m. (In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, MDL No. 2441)
The Stryker hip recall for Rejuvenate and ABG II hip stems was issued in July 2012, after Stryker determined that the metal components were prone to fretting and corrosion at the modular neck junction. According to Stryker, patients fitted with Rejuvenate and ABG II stems may be at risk for adverse local tissue reactions characterized by pain and swelling around the hip joint. However, some asymptomatic patients have also developed adverse local tissue reactions. As such, all Rejuvenate and ABG II patients have been advised by the company to undergo medical screening to ensure the integrity of their hip components.*
Alleged victims of the Stryker hip recall for Rejuvenate and ABG II hip stems may be entitled to compensation for medical bills, lost wages, and pain and suffering.
