Stryker Hip Lawsuits Proceed in New Jersey, With Issuance of New Case Management Order, Bernstein Liebhard LLP Reports

According to a Case Management Order issued on October 8, 2014, the Court’s ongoing medication efforts have resulted in the settlement of an additional case selected for Phase II of the Early Medication program. Of 21 cases chosen for Phases I and II, 20 have been resolved. The Court has also designated 10 Stryker hip recall claims for Phase III, and those cases are now being prepared for mediation. Court records indicate that more than 2,100 Stryker hip lawsuits have been filed in Bergen County Superior Court since the recall was announced. All of these claims similarly allege that the defective nature of the Rejuvenate and ABG II hip stems caused recipients to suffer chronic pain, metallosis, osteolysis, tissue necrosis, and other complications that resulted in premature failure of their hip implant.
In addition to the claims pending in New Jersey, more than 1,700 lawsuits involving similar allegations have been filed in a federal multidistrict litigation underway in U.S. District Court, District of Minnesota. According to the U.S. Food & Drug Administration (FDA), Rejuvenate and ABG II hip stems were named in a worldwide recall on July 6, 2012, after the metal components were found to be vulnerable to fretting and corrosion at the modular-neck junction. According to Stryker, this may place recipients of the implants at risk for adverse local tissue reactions, pain and swelling. The company has recommended that all patients fitted with one of these devices undergo medical testing and imaging screening to ensure their device is performing as intended, even if they have not experienced any symptoms that would suggest otherwise.*
