Stryker Hip Recall Litigation Looks Ahead to January Status Conference, Bernstein Liebhard LLP Reports
New York, NY (PRWEB) December 31, 2014 -- A consolidated litigation involving Stryker hip lawsuits (http://www.consumerinjurylawyers.com/stryker-rejuvenate/stryker-hip-lawsuits/) is looking ahead to its first status conference of the New Year, scheduled to take place in New Jersey’s Bergen County Superior Court, Bernstein Liebhard LLP reports.
According to a Calendar posted on the Court’s website, the meeting will take place on January 20th, 2015, and will discuss matters related to lawsuits involving the Stryker Rejuvenate and ABG II modular-neck hip stems. Plaintiffs in these cases received the hip replacements prior to their recall on July 6, 2012, after which time they allegedly experienced pain, swelling, a loss of mobility and other symptoms associated with metallosis (metal ion poisoning). Stryker hip Lawsuits
When court records were updated on November 18th, at least 2,160 Stryker hip recall lawsuits had been filed in the Bergen County litigation. A few weeks earlier, the court announced a settlement that could affect thousands of claims filed in U.S. federal and state courts that involve the Rejuvenate and ABG II hips. The details of the global settlement program were announced on November 3rd, and specified that individuals could receive $300,000 as a base award, per failed implant. Pursuant to the terms of the settlement, there can be reductions or enhancement to the base award depending on case specific factors. Stryker claimants who require revision surgery but are medically unable to undergo the procedure will also be eligible for payment under the proposed settlement program.
All the lawsuits now pending in Bergen County were filed after the 2012 Stryker recall, and similarly allege the fretting and corrosion of the Rejuvenate and ABG II implants’ metal components. Similar claims have also been centralized in the U.S. District Court, District of Minnesota, where a federal multidistrict litigation is underway. Court documents updated on December 15th show nearly 2,240 cases now filed in the proceeding, the counsel in which have also been named signatories to the Stryker agreement.
