Stryker Lawsuit News: Bernstein Liebhard LLP Notes New Order in New Jersey Stryker Recall Litigation

According to court documents, a Case Management Order was issued on July 26th that addresses a number of issues, including the scope, parameters and timing for written discovery, as well as the selection of Stryker lawsuits for mediation. Stryker Recall Lawsuits
Court records show that more than 270 Stryker lawsuits have been filed in the New Jersey litigation on behalf of plaintiffs who allegedly suffered a number of serious complications due to fretting and corrosion of the recalled hip implants, including metallosis, necrosis and osteolysis. In April, Bergen County Superior Court Judge Brian R. Marinetti established guidelines for the selection of cases for early mediation. However, his order stipulated that the Stryker recall litigation will move forward while the mediation takes place.
In May, the U.S. Judicial Panel on Multidistrict Litigation (JPML) established a multidistrict litigation in U.S. District Court, District of Minnesota, for all federally- filed Stryker lawsuits involving Rejuvenate and ABG II stems. Court documents show that at least 159 complaints are pending in that litigation. The Initial Case Management Conference will be held on September 9, 2013. Stryker recalled its Rejuvenate and ABG II hip stems in July 2012, after the metal components were found to be prone to fretting and corrosion at the modular neck junction, and warned this could cause patients to suffer pain, swelling, adverse local tissue reactions, and ultimately failure of their hip. All patients affected by the Stryker recall have been advised by the company to undergo medical screening regardless of symptoms to ensure their hip components are working properly.*
