Stryker Recall News: Filings Mount in New Jersey Litigation Established for Stryker Hip Lawsuits, Bernstein Liebhard LLP Reports
New York, NY (PRWEB) July 29, 2013 -- One year after the announcement of the Stryker recall for Rejuvenate and ABG II Modular-Neck Hip Stems, Bernstein Liebhard LLP’s Stryker Hip Recall Center reports that claims filed on behalf of allegedly injured patients continue to mount in a consolidated litigation underway in New Jersey’s Bergen County Superior Court. According to a Case List issued by the Court on July 23rd, some 273 Stryker lawsuits have been filed in the litigation since it was first established in January 2013. Stryker Recall
Announced in July 2012, the Stryker recall was issued after postmarket data indicated the metal hip stems were prone to fretting and corrosion at the modular neck junction. This occurrence can allow dangerous levels of metal ions to build up in the tissue surrounding the joint, leading to pain, swelling and adverse local tissue reactions. Stryker has advised all recipients of the Rejuvenate and ABG II hip stems to undergo medical screening to ensure their hips are functioning properly, even if they have not experienced any symptoms that would indicate the device has failed.*
According to court documents, all of the Stryker lawsuit claims filed in New Jersey allege that the Rejuvenate and ABG II components caused recipients to develop metallosis and other complications that led to premature failure of their hip. In addition to the claims pending in New Jersey, at least 159 complaints that make similar allegations have been filed in a federal multidistrict litigation now underway in U.S. District Court, District of Minnesota. Court documents indicate that the Initial Status Conference in the federal proceeding will be held on September 9, 2013 at 1:30 p.m. (In re: Stryker Rejuvenate and ABG II Hip Implant Products Liability Litigation, MDL No. 2441)
