According to court documents the litigation involves allegations that Syngenta misled US corn growers that its insect-resistant strain of corn MIR 162 – sold as “Viptera” and “Duracade” – would be approved by China, a vital importer of American corn. Per this expectation, thousands of US farmers purchased and planted MIR 162.

China has delayed the approval of MIR 162, and, as a result of cross contamination of US corn exports with that genetic modification, has significantly reduced importing US corn. As a result, US farmers, distributors and exporters have suffered billions of dollars in losses, while the excess supply of corn in the US market has depressed prices domestically and internationally.
