The federal court overseeing hundreds of testosterone treatment lawsuits (http://www.testosteronelawsuithub.com/) has amended its protocols governing Service of Process. Specifically, the Case Management Order issued on April 10th in the U.S. District Court, Northern District of Illinois, amends the manner in which plaintiffs may request a waiver of service from certain defendants, including AbbVie, Inc. and Abbott Laboratories. Testosterone Treatment Litigation
Currently, more than 1,100 testosterone treatment lawsuits are pending in the federal multidistrict litigation underway in Illinois, all of which were filed on behalf of men who allegedly suffered heart attacks, strokes, blood clots and other dangerous cardiovascular events related to the use of prescription testosterone replacement therapies. These plaintiffs further allege that the drug’s manufacturers failed to provide adequate warnings about their serious heart risks, and wrongly marketed the medications as safe and effective remedies for low libido, weight gain, fatigue and other symptoms associated with age-related drops in testosterone. The complaints point out that the U.S. Food & Drug Administration (FDA) has only approved testosterone therapy for men who suffer from hypogonadism, a reduction in testosterone related to an underlying illness or injury.
According to court documents, the FDA began reviewing the cardiovascular risks associated with prescription testosterone medications in January 2014, after a few studies indicated the drugs were associated with an increased risk of heart attacks, strokes, and death in certain men.* In an updated safety alert issued on March 3rd, the agency announced that the drug’s labels would be modified to include information about a possible link to heart attacks and strokes, and to clarify their approved uses. The FDA voiced concern that the drugs were increasingly being used to treat age-related symptoms in men, even though they have never been shown to be safe or effective for this purpose.
