Testosterone treatment lawsuits (http://www.testosteronelawsuithub.com/) filed against the manufacturers of AndroGel and other low testosterone therapy medications continue to move forward in the multidistrict litigation now underway in the U.S. District Court, Northern District of Illinois. According to a Motion filed on May 4, 2015, defendant AbbVie, Inc. has asked the court to delay the bellwether trial selection process for cases involving its AndroGel product in order to resolve what it purports are issues with some Plaintiffs’ Fact Sheet submissions. (In re: Testosterone Replacement Therapy Product Liability Litigation - MDL No. 2545)
“The bellwether trials are of great importance because they will likely provide valuable insight into how juries will rule in similar cases. We are monitoring this matter with interest, as our Firm is representing a number of testosterone lawsuit plaintiffs who have cases pending in the federal litigation,” says Sandy A. Liebhard, a partner at Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm continues to offer free case reviews to men who may have been harmed by low testosterone therapy medications.
Testosterone Treatment Lawsuits
According to court documents, more than 1,500 testosterone treatment lawsuits are currently pending in the Northern District of Illinois, all of which allege that use of testosterone replacement therapies are associated with an increased risk of heart attacks, strokes, and other dangerous cardiovascular events. In addition, plaintiffs accuse the drugs’ manufacturers of wrongly marketing their products as safe and effective treatments for low libido, fatigue and other symptoms associated with age-related drops in testosterone, even though the medications have never been approved for this purpose.
Court records indicate that the testosterone litigation began to grow shortly after the U.S. Food & Drug Administration (FDA) disclosed on January 31, 2014 that it was reviewing the cardiovascular risks potentially associated with testosterone therapy*. In an update issued on March 3, 2015, the FDA announced that the labels of prescription testosterone treatments would be modified to include information about their potential association with heart attack and stroke. The agency also mandated that language pertaining to the drugs’ approved indications be clarified to state that such therapy has not been proven safe and effective for relieving symptoms associated with age-related reductions in testosterone.
Men who have undergone low testosterone therapy may be entitled to compensation if they allegedly experienced heart attacks, strokes or other cardiovascular events related to their treatment.
