Testosterone Lawsuits Move Forward, With Issuance of New Case Management Order in Federal Litigation, Bernstein Liebhard LLP Reports

A new Case Management Order governing hundreds of federally-filed testosterone lawsuits (http://www.testosteronelawsuithub.com/) has been issued in the multidistrict litigation currently underway in U.S. District Court, Southern District of Illinois, Bernstein Liebhard LLP reports. The October 6th Order sets forth the form, procedure and schedule for the completion and service of Plaintiff Fact Sheets, as well as the execution of authorizations for the release of certain records, including medical, mental health and employment records.

Since January, these medications have been the subject of an FDA safety review, which was launched after two studies suggested that low testosterone treatments might increase the risk for heart attacks, strokes and death in older men, or those with pre-existing heart disease. In September, a panel of outside advisors convened by the FDA recommended that the manufacturers of testosterone replacement therapies be required to conduct studies of their cardiovascular side effects. The advisors also recommended that the labeling for the medications be revised to make clear they have not been shown to lessen low libido, fatigue, muscle loss and other symptoms commonly experienced by men as they age.**

Court documents indicate that more than 200 testosterone treatment lawsuits have been filed in the Northern District of Illinois on behalf of men who allegedly experienced serious heart problems due to their use of AndroGel, Testim and similar drugs. Among other things, plaintiffs in these cases allege that the manufacturers of low testosterone therapies failed to warn doctors and patients about their potential risks, and concealed those dangers from the public.
