Testosterone Lawsuit Accuses Drugs’ Manufacturers of Engaging in Deceptive Marketing, Bernstein Liebhard LLP Reports

A testosterone lawsuit (http://www.testosteronelawsuithub.com/) recently filed in the multidistrict litigation now underway in the U.S. District Court, Northern District of Illinois, is seeking reimbursement for the costs insurance companies incurred covering prescriptions for AndroGel, Testopel, Axiron, Androderm and Fortesta Gel, Bernstein Liebhard LLP reports. The November 5th filing alleges that the manufacturers of testosterone therapies engaged in deceptive marketing, and caused insurers to pay billions of dollars for unsafe and ineffective medications. Among other things, the class action lawsuit points out that federal regulators have only approved testosterone replacement drugs for the treatment of hypogonadism (low testosterone) caused by an underlying medical condition. However, the complaint asserts that pharmaceutical companies marketed testosterone products as treatments for age-related issues, such as erectile dysfunction, diabetes, depression, and obesity. According to court documents, more than 220 testosterone lawsuits are now pending in the litigation underway in the Northern District of Illinois, all of which claim that the manufacturers of low testosterone therapies failed to warn doctors and patients about their potential cardiovascular risks, and concealed those dangers from the public. The lawsuits further allege that the manufacturers of the medications engaged in deceptive advertising that induced many men to use the potentially dangerous treatments, even though they had no real medical need for testosterone replacement therapy. Court documents indicate that the litigation involving testosterone treatments has been growing since January, when the U.S. Food & Drug Administration (FDA) launched a safety review of their cardiovascular risks. In September, a panel of outside advisors convened by the FDA recommended that the manufacturers of the medications be required to conduct studies of their cardiovascular side effects. The advisors also recommended that the labeling for low testosterone therapies be revised to make clear they have not been shown to lessen symptoms typically associated with aging in men.*
