Testosterone treatment lawsuits (http://www.testosteronelawsuithub.com/) filed against the manufacturers of AndroGel, Testim, Axiron and similar drugs continue to move forward in the federal multidistrict litigation now underway in U.S. District Court, Northern District of Illinois, Bernstein Liebhard LLP reports. According to an Order dated December 19, 2014, the Court has established a new Case Management Plan that governs Plaintiffs’ merit discovery in cases involving Auxilium Pharmaceuticals, Inc. (Auxilium defendants); Eli Lilly and Company and Lilly USA, Inc. (Lilly defendants); Actavis, Inc., Actavis Pharma, Inc., Anda, Inc., Watson Laboratories, Inc. (Actavis defendants); Pfizer Inc. and Pharmacia & Upjohn, (Pfizer defendants); and Endo Pharmaceuticals, Inc. Among other things, the Order directs the parties to meet and confer on the nomination and selection of bellwether cases involving these defendants, and the scheduling and/or deadlines pertaining to fact and expert discovery for such bellwether trials. “Our Firm is currently investigating a number of claims on behalf of men who allegedly suffered life-threatening cardiovascular events due to their use of low testosterone therapy, and we continue to receive inquiries from others who claim to have had similar experiences. The outcome of bellwether trials held in this proceeding will provide insight into how juries might decide similar testosterone lawsuits,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is now evaluating potential testosterone treatment lawsuits on behalf of men who allegedly experienced heart attacks, strokes, deep vein thrombosis, pulmonary embolism, and other cardiovascular side effects due to their use of low testosterone therapy.

Testosterone Treatment Litigation
Court records indicate that more than 270 testosterone treatment lawsuits are now pending in the proceeding underway in the Northern District of Illinois, all of which claim that testosterone replacement therapies may increase the risk for heart attacks, strokes and other serious cardiovascular side effects. Among other things, the complaints allege that the manufacturers of these drugs failed to warn doctors and patients about their potential risks, and concealed those dangers from the public. Plaintiffs further claim that sales of prescription testosterone products were driven by deceptive marketing tactics that induced many healthy men to use the drugs in the absence of a true medical need.

The federal testosterone litigation was established shortly after the U.S. Food & Drug Administration (FDA) announced on January 31, 2014 that it was evaluating the cardiovascular risks associated with low testosterone therapy. Since then, a panel of FDA advisors recommended that the drugs’ labels be revised to make clear they have not been shown to lessen low libido, fatigue, muscle loss and other age-related symptoms. They also recommended that the manufacturers of testosterone replacement therapies be required to conduct studies of their cardiovascular side effects.*

Men who suffered life-threatening cardiovascular events due to their use of low testosterone therapy may be entitled to compensation for their injury-related damages.
