(Actavis defendants); Pfizer Inc. and Pharmacia & Upjohn, (Pfizer defendants); and Endo Pharmaceuticals, Inc. Among other things, the Order directs the parties to meet and confer on the nomination and selection of bellwether cases involving these defendants, and the scheduling and/or deadlines pertaining to fact and expert discovery for such bellwether trials. Among other things, the complaints allege that the manufacturers of these drugs failed to warn doctors and patients about their potential risks, and concealed those dangers from the public. Plaintiffs further claim that sales of prescription testosterone products were driven by deceptive marketing tactics that induced many healthy men to use the drugs in the absence of a true medical need.
The federal testosterone litigation was established shortly after the U.S. Food & Drug Administration (FDA) announced on January 31, 2014 that it was evaluating the cardiovascular risks associated with low testosterone therapy. Since then, a panel of FDA advisors recommended that the drugs’ labels be revised to make clear they have not been shown to lessen low libido, fatigue, muscle loss and other age-related symptoms. They also recommended that the manufacturers of testosterone replacement therapies be required to conduct studies of their cardiovascular side effects.*
