Dozens of Testosterone Lawsuits Permitted to Proceed in Federal Litigation, Bernstein Liebhard LLP Reports
New York, New York (PRWEB) January 05, 2015 -- The federal court overseeing hundreds of testosterone lawsuits (http://www.testosteronelawsuithub.com/) filed against the manufacturers of AndroGel, Axiron, and other low testosterone therapies has refused a bid by defendants to dismiss 39 cases pending in the litigation, Bernstein Liebhard LLP reports. According to an Order issued on December 23, 2014 in the U.S. District Court, Northern District of Illinois, the defense had argued that plaintiffs failed to sufficiently allege that testosterone replacement drugs had caused their cardiovascular injuries, asserting, among other things, that studies cited in their complaints had been discredited. But the Court pointed out that the plaintiffs had cited both studies and recent regulatory action that require all prescription testosterone treatments to carry warnings about a potential risk for venous thromboembolism. Court records indicate that the multidistrict litigation underway in Illinois was established this past June, after the U.S. Food & Drug Administration (FDA) announced on January 31, 2014 that it had launched a review of the medications. Since then, a panel of FDA advisors has recommended that the drugs’ labels be revised to make clear they have not been shown to lessen low libido, fatigue, muscle loss and other issues commonly experienced by men as they age. They also recommended that the manufacturers of testosterone replacement therapies be required to conduct studies of their cardiovascular side effects.*
According to court documents, more than 270 testosterone lawsuits are currently pending in the federal litigation, all of which were filed on behalf of men who suffered heart attacks, strokes, blood clots and other life-threatening cardiovascular events due to their use of low testosterone therapies. Among other things, the complaints allege that the manufacturers of these drugs concealed their potentially dangerous side effects from the public, and failed to warn doctors and patients about those risks. Plaintiffs further allege that sales of the medications were driven by misleading marketing claims that induced many healthy men to use the drugs in the absence of a true medical need.
