More than 1,000 testosterone lawsuits have been filed in federal court since the FDA announced a little over a year ago that it had launched a review to assess the cardiovascular risks potentially associated with low testosterone therapy.

According to an updated Docket report issued by the U.S. Judicial Panel on Multidistrict Litigation (JPML) on February 17th, 1,017 cases are now pending in the proceeding. Court documents indicate the Panel reported 270 filings as of December 15, 2014, so these new figures represent a substantial increase. Testosterone Allegations
Court records indicate that the testosterone lawsuits have been mounting in U.S. courts since the Food & Drug Administration (FDA) revealed on January 31, 2014 that it was reviewing the cardiovascular side effects allegedly associated with low testosterone therapy. Since then, a panel of FDA medical advisors has recommended that the agency order the drugs’ manufacturers to conduct large-scale studies to better assess their heart risks. The panel also called on the FDA to revise the medications’ safety labeling, so that it is clear that low testosterone therapy has not been shown to alleviate low libido, loss of muscle mass, fatigue and other symptoms usually associated with drops in testosterone normally caused by the male aging process.*

According to court documents, all of the testosterone lawsuits currently pending in the Northern District Illinois accuse the medications’ manufacturers of concealing the heart risks allegedly associated with the drugs, including an increased risk of heart attacks, strokes, deep vein thrombosis and pulmonary embolism. Plaintiffs further claim that sales of the drugs were driven by aggressive marketing that positioned low-T therapy as a remedy for symptoms associated with age related drops in testosterone, an indication for which they have not been approved.
